Monday Market Myth: Deposit Limit on Rentals

Myth: In California a landlord can set a deposit at any amount they seem appropriate for the rental.

False: The maximum amount a tenant can be charged for an unfurnished rental is two months rent and a furnished rental is three months rent.  If the landlord has collected more than the appropriate amount, then the tenant reserves the right to receive the extra money after termination of the lease no matter the consequence.   A stronger rental market, which we currently have in Hollister, sometimes leads to higher deposits, so tenants beware of unfavorable deposits.
